What was agreed

This complaint concerns allegations that EC Credit Control continues calling people after being told to stop, while pressuring them to accept responsibility for debts they say are not owed by them or their company.

Consumer’s account

The concern is that clear disputes about liability and requests for no further contact are being disregarded. Repeated calls and pressure to acknowledge a disputed debt are, in my view, bullying and unacceptable. People should be able to challenge liability without being worn down into accepting a debt simply to make the calls stop.

Attempts to resolve

Told them NOT to call, and wrote to them disputing the alleged account

Requested resolution

Stop the unwanted calls, provide written evidence identifying the debtor and establishing the basis of any alleged liability, investigate the dispute properly, correct any inaccurate records, and provide a substantive written response.

I am calling for the Commerce Commission to examine the collection conduct, the Privacy Commissioner to investigate any misuse or inaccurate use of personal information, and New Zealand Police to assess whether the alleged conduct meets the legal threshold for harassment. If breaches are established, I want appropriate enforcement to stop the conduct and prevent it recurring.

EC Credit Control is invited to respond to these allegations and explain how it handles disputed liability and requests to stop telephone contact.
